Construction on Public Land Not Religious Freedom: 
Allahabad High Court- Outlook India
ALLAHABAD | OCT 31, 2013

The right to religious freedom enshrined in the Constitution is "subject to public order, morality and health" and does not include raising unauthorised constructions on public land, the Allahabad High Court has held.

In an order dated October 25, a division bench comprising Justice Sunil Ambwani and Justice Bharat Bhushan also disapproved of the Uttar Pradesh government's proposal to "regularise" more than 40,000 constructions of religious nature made on public land.

"We cannot countenance to the stand of the state government that it proposes to regularise 42,381 constructions of religious nature made on public land, without disclosing the area occupied by such constructions, the nature of land, the persons who have raised such constructions and the policy by which these constructions are proposed to be regularised," the court said.

The court made the observations following an affidavit filed by the state's Principal Secretary (Home) wherein it was submitted that there were 46,181 constructions of religious nature on public land across the state prior to 29.09.2009, out of which the state government had removed only 88 constructions, while 47 had been relocated.

It was also submitted in the affidavit that the state government proposed to regularise 42,381 such constructions, but the court remarked "we find it difficult to accept any such policy... The freedom of conscience and free profession, practice and propagation of religions and freedom to manage religious affairs under Articles 25 and 26 of the Constitution is subject to public order, morality and health.

"This freedom does not include raising unauthorised constructions over public land and claiming any protection or any right to regularise them." 

Fixing December 2 as the next date of hearing, the court directed the Principal Secretary (Home) to get a detailed survey of all such constructions done and submit a report.

The court also asked the government to frame a policy for reviewing unauthorized constructions "on a case to case basis" as directed by the Supreme Court in an order passed in 2009.

The order was passed in course of hearing on a petition filed by Abdul Kayyum, a resident of Badaun district who had moved the court seeking directions to the local administration for curbing the use of loudspeakers at a temple in his village.

Yes I also spoke with them. I won't go with them if service is like this.  Looks like TTPL is the only option now.  In some other forums people are actually happy with the TTPL service now.  As per them they are doing good from last couple of months.

On enquiry over phone they told that Tower G is approved from GDA and by HDFC only for funding. construction will start in Tower G next year Jan or so..


please comment if we all tower G buyers have got such letter or have some other  info.

Hi,

I had a talk with Mr Saurabh regarding the increased area. He told me that in carpet area  some balcony size is increased, the size of balconies should be a standard size as per the GDA's.

He also tell me that some people from GDA come to Cr and visit ASSOTECH and did grounding and they are having bankables till Diwali.I don't Know how much is this true.


Is anyone has any talk about project approval or increased size .Plz share.

First of all nowhere they have mentioned about the amount of space allotted for common area in the agreement. They are taking advantage of that and in order to adjust the fine they have to pay for the delay, they are playing this kind of games.

As per the letter "based on the response of prospective buyers they have increased the super area." But they have not taken any agreement of flat owners before doing this. In agreement they have mentioned about 1250 sqft only for tower E. We should strongly oppose this kind of illegal demand from Assotech.

While selling towers E&F the salesman never declared about two more towers(G&H) in between, though I see a reference to phase 3 in the pamphlet. This actually blocks the common open area for towers A to F. This is opposite to the claim made in the letter that "this change is done to make it better and more open for a comfortable living." Rather tower A to F owners should claim some grievance amount for the whole area of G and H from the builder.

2) Builder has included Registry Charges and is calculating it on entire amount (including parking, IFMS etc) rather than on Base Flat amount. Please confirm what is the correct calculation and if anyone knows a good advocate who can help me get it done from outside.

3) Please confirm if all owners have paid Club charges at the time of possession. I'm asking this as I can see a further 1 year delay in Club and Swimming pool.

4) What is the difference between IFMS (already included in the pending amount) and Maintenance charges for 1 year included in the letter now.

5) Also there is a mention of mainteance charges as 0.30 p / sq ft for Crossing Township maintenance. How is it different from EDC charges.

6) Electric Dual Source Meter charges 15,000 and Power Back up charges of 20,000 per KVA (though for 1 KVA it is already included in my pending amount and if I get it increased to 2 KVA then it should be at same price as mentioned in my allotment letter.)

I've raised the queries to the builder but would really appreciate if any existing owners from Nest could enlighten us with the information and discussion they have already done with builder.
