Yesterday the Hon'ble Allahabad High Court while dismissing the application filed u/s 482 Cr. P. C. by Mr. Rajiv Gupta & other Directors of the Company namely Shreya Developwell P. Ltd. (case No. 11978/2011, Misc. application, criminal) ordered the Directors of Shreya Developwell P. Ltd. the Builder Company i.e. Mr. Rajiv Gupta, Mr. Manoj Sharma & Mr. Anuj Sarin to appear in the trial court at Ghaziabad within 30 days.
The court further observed that the builder preferred for Mediation but did not appear in the Mediation proceedings further no one from the Builder company was present in the court.
Facts of the case:
The Builder comapny Shreya Developwell P. Ltd. has launched its project at NH - 58 known as Raj Nagar Extn. for allotment of fully developed flats in its project 'Hindon Heights',the project was to be completed by Dec. 2008, giving fully developed plots at 'Hindon Valley', & farmhouses in its project at Machan 'Hapur'. The total amount accumulated by the company is estimated app. 300-350 crores of rupees.
Till date the company has not given possession of a single flat, plot or farmhouse. as per documents available with the Association the Builder has transferred a lot of amount to its Subsidiary companies and invested in the purchase of Luxurious Cars such as BMW, Ford and personal properties etc.
I request the members of the Group to see if any of their friend, relative or Associate has booked any flat etc with the said Builder ompany i.e. Shreya Developwell P. Ltd. to please advise him to join the Association namely, "Hindon Heights Flats Allottees Association" immediately by contacting the undersigned to recover their hard earned money deposited with the aforesaid Builder Company i.e. "Shreya Developwell P. Ltd."
