That gives us to at least a chance be a party to the ongoing law suit, as it is any way illegal.

Dear Krishanu,
The minimum distance between dumping yard and a residential area is 500 mtrs., which have been overlooked by the various authorities, till now.

I am sure the Indian Penal Code is not so weak, there must be option other than going for a dharna in front of the empty dump yard, may be we haven't explored enough.

> Mahesh, I want to clarify few things to you, You are right that builders petition may be thrown out and dismiss with heavy cost, which was our doubt at the time when builders were filing the petition . Thankfully the notice was issued and we got some other hope. But I tell on the first date when notice was issued ,the Supreme Court judges realized by reading the facts that something fishy is in the matter at the hands of the State Govt. against the builders. Only on this basis the notice was issued. Also court asked why the residents have not challenged the order who had filed petition in the High Court. On questioning about the status of residents, the builders lawyers were mum.
>
> Thereafter we met various lawyers to take opinion on the matter how to take next move. With the advise and opinion of senior lawyers, It was decided that we should join in the builders petition in Supreme Court by fling an intervention application. We started drive for collection of fund. But due to nuisance created by few and doubt created on CROMA identity & credibility, the funds were not collected and whatever amount was collcted the same was returned to the respective person in each society,to avoid any finger on CROMA and CROMA stopped that action plan of going to Supreme Court .I am still of the opinion that if we go to Supreme Court some weightage will be given to the builders petition and we may get some relief. But that need to be done with big unity and very carefully and for this we need to take known face of the legal industry to get the order in favour. If you agree with this view please come forward an take lead. But in this matter
> don't take any action individually as in the past few resident went alone in the High Court and petitions were tagged with builders petitions and all petitions were dismissed. That is the reason I have not filed any petition individually in the High Court or Supreme Court at yet which I would have done very easily. Filing many petitions individually may have impact of weaken the case stand.
>
> Also on action plan of NATIONAL GREEN TRIBUNAL, with the advise of Supreme Court Environmental Expert, that since the Enviornment Clearance for the project is still pending, we filed a representation before the Secretary, Ministry of Enviornment and Forest which was forwarded to the State Enviornment Ministry which is still pending for closure. We are about to sent reminder on that pending file before the Ministry of Enviornment. This fact was also shared with everyone on all yahoo group and facebook page. As far your reply to our action plan of going to National Green Tribunal is concern, I must clear you that since till date the State Impact assessment authority has not given Environment Clearance for the project this is the reason we have not file any complaint in NCT till date and we are waiting for the appropriate stage for that move Therefore I am not agreeing with your virws that National Green Tribunal will not hear our petition ,If we
> move in that direction. Since once the title of that 14 acre land reach to some conclusion by the builders petition in Supreme Court or after the grant or non -grant of Enviornment Clearance the cause of action arise for National Green Tribunal.

> You may be correct in your views and I may be wrong. It is a legal battle based on various documents and different opinion. Mahesh, It is very easy to write e-mail questioning on someone hard word work and effort. But before questioning at least think proper and use proper language while writing on the blog. You are not only writing I am False, am False you have questioned the entire CROMA team who had put lot of work for the matter.Mahesh, each step was taken with proper application of mind and opinion of senior lawyers and various intelligent members in the group. At that time you never turned up b'coz you are busy with your personal matter. But opinion varies from person to person that is why there are Senior Lawyers and ordinary lawyers in the legal industry. I may not be intelligent as you, but at least I have that mien what to write and what not to write on the blog with proper language so that it may not hurt the sentiments of any one. In

> Also as you said in your last e-mail that CROMA has never come forward to help you in your shopping complex matter. On this issue, Mahesh I would like clarify you that shopping complex is in front of your tower which was not planned by the builder as per terms and conditions agreed with you. This was very much personal matter . CROMA role model does't come into picture for this issue. For such matter their need to be a privity of contract between the builder and association to have some strength to intervene . I know you have written many e-mails for the help, but decision was taken by CROMA not to intervene b'coz of the abovesaid reason. Such kind of issues are there in other societies also, but from the very beginning CROMA decided not to intervene in such issues as such falls within persons personal capacity o later on RWA can intervene for help.

I am with you and I request everyone to be with you.Now at this juncture I advise all the residents to take next move to solve the issue with your expert advise and opinion. Anyone who has Rs.20,000 (rupees twenty thousand only) to spend can file a case in high court. Anyone who has Rs.50,000 (rupees fifty thousand only) to spend can file a case in supreme court. That's the amount it costs to hire a lawyer and file cases at these two forums.

> >3. The stand taken by Akhil that ' it is the residents who are in strong hands to demand from the govt. authorities to take back the decision to shift this dumpyard at some other place by Dharna/Pradarshan' is completely false. Like i said before the Dumping Ground was proposed way back in year 2000. Later the land use of Dumping Ground was, by means of corrupt and ILLEGAL means, changed from 'Dumping Ground' to 'Residential'. The adjoining plots were sold and the building were erected and the flats were sold. Just imagine yourself would you buy a piece of land if you knew that a KUDADAN is proposed next to it. Later on inspection when it was found that the land use was illegally changed the Govt. changed the land use back to 'Dumping Ground'. So in summary builders have no case. In my opinion the case in supreme court will be thrown out with heavy cost. WHY? because the case is a means to cover up fraud and supreme court does not like fraud very
> much. This case smells worse than the Dumping Ground.
> >
> >
> >
> >4. The stand taken by Akhil that 'However, for legal action on Enviornmental Factors, we /the residents has the right to raise the voice before National Green Tribunal for which we are waiting as the last recourse.' is completely false. The very inception of Dumping Ground itself was made to protect the environment. Dumping Ground is a scientific way of disposing waste as per the court and The Hon'ble Supreme court by its direction in 1996 (Writ Petition No.888 of 1996 Almitra H. Patel vs. State of UP & others) asked government to setup Dumping Grounds all over the country. Dumping Ground as per supreme court is a measure to save the environment and it is beneficial to the community. National Green Tribunal can only encourage it and not stop its construction contrary to what Akhil suggests.

A fraud at a massive scale. A fraud that effects 1 lakh people. A fraud that will inflict cancer on your children. See the movie Erin Brockovich.

If we request to the builders to go for dharna/pradrashan , no one will listen to the builders. Builders are also a victim in the hands of Govt like we are in the hands of builders in the present case.I can understand that as we are victims at the hands of builders as well as authorities for which we have legal way to take action against the builders for breach of trust or by any other cause which no one has guts uptill now. Mahesh has rightly taken action vis-a-vis Mahagun Shopping complex is concern. But everyone is not like Mahesh and also Mahesh is facing the consequences of that ,till date his Flat is not being handed over for which he has to fight separately another round of litigation and also by doing this litigation he has faced some medical problem as apparent from his e-mail. Despite being a lawyer I am saying all this

Still builders are in better position in all respect rather than us. Please understand with builders we can fight any time but not at this stage when builders are already fighting and went upto SUPREME COURT, the Apex court of the country and the fate of that case can take any direction.

We are trying our luck with a positive hope from new UP Chief Minster, Mr. Akhilesh Yadav who is from Environmental Engineering background. We are also trying to escalate the issue by sending our representation through own sources to his office which is also in pipeline and also trying to fix our meeting with him. We are repeating this protest to bring into their knowledge about the issue as well as to stop the construction started at the site by showing unity and strength of the crowd at Crossings Republik and nearby areas. For this we need support of maximum residents as much as possible.

But if we have energy and we can protest and can unite then surely we will have some solution. The construction has already been started in DG and we don't want to this construction in front of this beautiful township and we know the result of this DUMPING GROUND as well. I have seen GAZIPUR as an example and don't want the same GAZIPUR in front of my flat/socety/township. We don't want our landmark as DUMPING GROUND.
>
>

Please come forwarded, I know you have the understanding of law as apparent from your views ad legal battle you have won for the shopping complex.

> >1. The stand taken by Akhil that 'Builder is fighting against Dumping Ground' is completely false. The case filed by builder against municipality is nothing more that a eye-wash.
> >

> >2. The stand taken by Akhil that 'Builder is also a loser because of Dumping Ground' is completely false.Builder has already sold the flats atleast most of them are sold. Builder has nothing to lose.

> >
> >
> >
> >
> >

> >I agree with Akhil and Raju to the extent that the residents need to unite on this matter. Residents need to wake up and see the truth. This is a fraud and nothing else.

Despite being a lawyer I am saying all this
> b'coz I know weakness of legal system in our Country. However, for legal action on Enviornmental Factors, we /the residents has the right to raise the voice before National Green Tribunal for which we are waiting as the last recourse.
> >
> >As suggested by you that we should start fighting with builders, in that case it will be very difficult to sustain in future as there is much development required in the township for which we need to push builders to place things properly as much as possible. Still builders are in better position in all respect rather than us. Please understand with builders we can fight any time but not at this stage when builders are already fighting and went upto SUPREME COURT, the Apex court of the country and the fate of that case can take any direction.
> >
> >
> >As per current scenario, it is the residents who are in strong hands to demand from the govt. authorities to take back the decision to shift this dumpyard at some other place by Dharna/Pradarshan . In the past builders were agreed to spent money to purchase land at some other place to shift this menace but all in vain b'coz of nuisance by City Mayor/M.P from BJP govt. in Ghaziabad.

Govt as well as appointment of new VC-GDA Mr. Santosh Yadav who has been assigned MISSION GHAZIABAD as priority as air in the city.

So excuse me on this but yes, now I want to make our township as well as our society a better place to live and that's why I am interested in this and calling the entire flat owners to come, unite and show the power. If a single man like you can fight against Mahagun Builder and can win then why not we unite and protest against the DUMPING YARD for our beautiful township.

I know the entire resident are not interested and even there are many residents who are not aware about this DUMPING GROUND. May be they don't care about this. So don't take it in another way, please come and join in this PROTEST/DHARNA/ANSHAN, if you think CROMA is a good place where people from entire society can meet and discuss on this matter openly.
